Terms of Service
Last Updated: October 18, 2026
1. Acceptance of Terms
These Terms of Service ("Terms") form a binding agreement between you and MattyJacks ("we," "us," or "our") governing your use of mattyjacks.com and related services (the "Service"). By accessing or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
You must be old enough to form a binding contract in your jurisdiction, and in any case at least 18 years old (or the higher minimum age required where you live). If you use the Service on behalf of an organization, you confirm you have authority to bind it.
2. The Service
We provide information, tools, and business services. We may modify, suspend, or discontinue any part of the Service at any time, with notice where reasonably practicable. Specific paid services may be governed by a separate written agreement, which prevails over these Terms where they conflict.
3. Accounts and Security
You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for activity under your account. Notify us promptly of any unauthorized use.
4. Acceptable Use
You agree not to: violate any applicable law or regulation (including export control, sanctions, anti-corruption, and consumer protection laws); infringe or misappropriate the rights of others; upload malware or attempt to disrupt, probe, or gain unauthorized access to the Service; scrape or harvest data in violation of our instructions or applicable law; send spam or unlawful communications; or use the Service to harm, harass, or defraud others.
5. Intellectual Property
The Service, including its content, design, text, graphics, and software, is owned by us or our licensors and protected by copyright, trademark, and other laws worldwide. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purpose. All rights not expressly granted are reserved.
You retain ownership of content you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, use, and display it solely as needed to operate and provide the Service. You confirm you have the rights necessary to grant this license.
6. Payments
Where fees apply, prices, billing terms, and taxes (including VAT, GST, or sales tax where applicable) will be presented before you pay or set out in a written agreement. Payments are processed by third-party providers. Except where mandatory law gives you a right of withdrawal or refund, fees are non-refundable unless we state otherwise.
7. Third-Party Services and Links
The Service may link to or integrate third-party services. We do not control and are not responsible for them, and your use is subject to their terms and policies.
8. Privacy
Our handling of personal data is described in our Privacy Policy, which explains your rights under laws such as the GDPR, UK GDPR, CCPA/CPRA, LGPD, and PIPEDA.
9. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free. Nothing in these Terms excludes or limits any warranty or right that cannot be excluded under applicable law, including statutory consumer rights.
10. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or USD 100.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, gross negligence or willful misconduct, or any liability that cannot be limited under applicable law. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
To the extent permitted by law, if you are a business user, you agree to indemnify us against third-party claims arising from your breach of these Terms or misuse of the Service. This section does not apply to consumers where prohibited by local law.
12. Suspension and Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or others. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of New Hampshire, USA, excluding its conflict-of-law rules, and the courts located there have jurisdiction, except that: (a) if you are a consumer, you also keep the protection of the mandatory consumer laws of your country of residence and may bring claims in the courts of that country; and (b) nothing here prevents you from contacting a local regulator or consumer authority. Before filing a claim, both parties agree to try in good faith to resolve the dispute informally by contacting the other for at least 30 days. The UN Convention on Contracts for the International Sale of Goods does not apply.
14. Compliance with Laws and Export
You may not use the Service if you are barred from doing so under applicable sanctions or export control laws. You are responsible for complying with the local laws that apply to your use of the Service.
15. Changes to These Terms
We may update these Terms from time to time. For material changes we will provide reasonable notice, such as by updating the date above or notifying you. Continued use after changes take effect constitutes acceptance, where permitted by law. If you do not agree to the changes, stop using the Service.
16. General
If any provision is held unenforceable, the remainder stays in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them in a merger or sale of our business. These Terms and the Privacy Policy are the entire agreement between us regarding the Service. We may provide these Terms in other languages for convenience; the English version prevails where permitted by law. Neither party is liable for delays caused by events beyond its reasonable control.
